Basis for this information
The Seller has neither an establishment nor a branch in Germany or Austria. The duty to publish these details therefore does not arise from § 5 DDG (formerly TMG), § 5 ECG or § 25 MedienG - those provisions apply to service providers established in those countries. The applicable duties are those of EU law:
- Article 5 of Directive 2000/31/EC on electronic commerce, implemented in Poland by the Act of 18 July 2002 on the provision of services by electronic means;
- Article 6 of Directive 2011/83/EU on consumer rights, implemented in Poland by the Act of 30 May 2014 on consumer rights.
Under the country-of-origin principle (Article 3 of Directive 2000/31/EC) the Seller is subject to Polish law; the scope and detail given here nevertheless match what a German-speaking customer expects from an Impressum.
Applicable law and dispute resolution
Because the offer is also addressed to consumers in Germany and Austria, the mandatory consumer protection rules of the country of the consumer’s habitual residence remain unaffected under Article 6 of Regulation (EC) No 593/2008 (Rome I). The law applicable to an individual contract is governed by the Terms and Conditions.
The European Commission’s Online Dispute Resolution (ODR) platform was repealed by Regulation (EU) 2024/3228 and discontinued on 20 July 2025; no link to it is provided. Please address complaints first to [email protected]. The right to bring court proceedings remains unaffected.
